3. Products and Product Information

Krockle sells sweets, desserts, confectionery products, and related items for delivery within the United States.

We make reasonable efforts to display product descriptions, images, ingredients, quantities, sizes, packaging, and prices accurately. However, minor differences may occur because products may be prepared, decorated, portioned, or packaged by hand.

Product colors and appearance may also vary depending on lighting, photography, screen settings, ingredient availability, production batches, and shipping conditions.

Krockle may change product ingredients, packaging, availability, descriptions, or specifications when reasonably necessary. Material substitutions will not intentionally reduce the overall nature or quality of the product.

4. Food Safety, Ingredients and Allergens

Krockle products may contain or come into contact with common food allergens, including:

• Milk and dairy products
• Eggs
• Wheat and gluten
• Peanuts
• Tree nuts
• Soy
• Sesame
• Other ingredients capable of causing allergic reactions

Customers with food allergies, intolerances, dietary restrictions, or medical concerns are responsible for reviewing available ingredient information and contacting Krockle before placing an order.

Do not consume a product if you believe it contains an ingredient that may cause an allergic or adverse reaction.

Products must be handled, stored, refrigerated, frozen, or consumed according to the instructions provided on the product, packaging, or website. Krockle is not responsible for deterioration or damage caused by improper handling or storage after delivery.

5. Orders and Acceptance

Placing an order constitutes an offer to purchase the selected products. An automated order confirmation acknowledges receipt of the order but does not necessarily mean the order has been accepted.

Krockle reserves the right to accept, reject, limit, or cancel an order when reasonably necessary, including because of:

• Product unavailability
• Incorrect pricing or product information
• Suspected fraud or unauthorized payment activity
• Shipping restrictions
• Unusual purchasing activity
• A violation of these Terms
• Technical or inventory errors

If Krockle cancels an order after payment has been collected, the applicable payment will be refunded to the original payment method.

Products are subject to availability. Adding a product to a shopping cart does not reserve inventory.

6. Pricing, Taxes and Payment

All prices are displayed in United States dollars unless otherwise stated. Prices may change without notice, but changes will not normally affect an order already accepted by Krockle.

Applicable taxes, shipping charges, discounts, and final order totals will be displayed during checkout.

Krockle uses Stripe and potentially other authorized payment providers to process transactions. By submitting payment information, you represent that:

• You are authorized to use the selected payment method
• The information provided is accurate and complete
• The payment provider may process the applicable charges
• Krockle may take reasonable steps to prevent fraudulent activity

Orders may be delayed, declined, or canceled if payment cannot be authorized or if additional verification is required.

Krockle is not responsible for fees charged by a customer’s bank, credit-card issuer, or payment provider.

7. Order Changes and Cancellations

You may request to change or cancel an order only if the order has not yet entered preparation, production, packaging, fulfillment, or shipping.

To request a cancellation, contact contact@krockle.us as soon as possible and provide your order number.

Once an order has been processed or preparation has started, the order cannot be modified or canceled because Krockle products are food items that may be prepared specifically for the customer.

Approved cancellations will be refunded to the original payment method. Processing times may vary depending on the payment provider and financial institution.

8. Shipping and Delivery

Krockle currently ships only to eligible addresses within the United States.

Shipping methods, charges, and available delivery estimates are displayed during checkout. Delivery estimates are not guarantees.

Delivery may be affected by carrier operations, holidays, weather, emergencies, incorrect addresses, access restrictions, service interruptions, or other circumstances outside Krockle’s reasonable control.

Customers are responsible for providing an accurate and complete delivery address, including any apartment, suite, building, or unit number.

Risk of loss passes to the customer when the order is delivered to the address provided or otherwise completed according to the carrier’s tracking information, subject to applicable law.

Additional shipping conditions are explained in Krockle’s Delivery & Return Policy, which is incorporated into these Terms.

9. Returns, Exchanges and Refunds

Refunds are not provided for personal taste preferences, minor handmade variations, incorrect addresses submitted by the customer, missed deliveries, improper storage, or products damaged after delivery.

If an order arrives damaged or incorrect, contact Krockle within 48 hours of delivery and provide:

• The order number
• A description of the issue
• Clear photographs of the product
• Clear photographs of the packaging

Krockle will review each eligible claim individually and may provide a replacement, store credit, partial refund, full refund, or another reasonable resolution at its discretion, subject to applicable law.

10. Promotions, Discounts and Coupons

Krockle may offer promotional pricing, discount codes, coupons, giveaways, free-shipping offers, bundles, or other limited-time incentives.

Each promotion may be subject to separate conditions displayed with the offer, including:

• Starting and expiration dates
• Minimum purchase requirements
• Eligible or excluded products
• Geographic or customer restrictions
• Single-use or per-customer limits
• Availability while supplies last

Unless expressly stated otherwise:

• Only one promotional code may be used per order
• Promotions cannot be combined
• Discounts have no cash value
• Discounts cannot be applied retroactively

Krockle may reject or cancel the use of a promotion when it results from fraud, misuse, duplication, unauthorized distribution, or a technical error.

Krockle may offer physical or electronic gift cards that can be redeemed toward eligible purchases through Krockle.us.

Gift cards are subject to the terms presented at the time of purchase and the following general conditions:

• Gift cards may be used only for eligible Krockle purchases
• Gift cards are not redeemable for cash except where required by law
• Gift cards cannot be used to purchase additional gift cards
• Promotional gift cards may have separate conditions
• Gift cards must not be resold without authorization

Customers are responsible for protecting gift-card codes. Krockle is not responsible for unauthorized use of a gift card after the code has been delivered to the purchaser or recipient, except where required by law.

Suspected fraud, unauthorized resale, or misuse may result in a gift card being suspended while the matter is reviewed.

Any expiration date, fee, limitation, or additional condition will be disclosed as required by applicable law and presented with the gift card or during purchase.

12. Customer Accounts

Certain website features may allow customers to create an account, save addresses, review orders, or manage preferences.

You are responsible for:

• Providing accurate and current account information
• Maintaining the confidentiality of your password
• Restricting unauthorized access to your device
• Activity performed through your account
• Notifying Krockle of suspected unauthorized access

You retain ownership of your original content, but by submitting it to Krockle, you grant Krockle a non-exclusive, worldwide, royalty-free, transferable, and sublicensable license to use, reproduce, adapt, publish, display, and distribute that content for operating, promoting, and improving Krockle.

You represent that submitted content:

• Is accurate and based on your genuine experience
• Does not violate another person’s rights
• Is not defamatory, threatening, discriminatory, or unlawful
• Does not contain malware or deceptive links
• Does not disclose another person’s private information
• Does not contain unauthorized commercial advertising

Krockle may moderate, reject, or remove content that violates these Terms, but is not obligated to publish or retain every submission.

14. Intellectual Property

Krockle.us and its content—including trademarks, logos, product names, product photography, graphics, text, recipes, designs, packaging, videos, website layouts, and software—are owned by or licensed to MTM Investments, LLC and are protected by applicable intellectual-property laws.

No ownership rights are transferred to you through access to the website or purchase of a product.

You may not copy, reproduce, distribute, modify, sell, license, publish, create derivative works from, or commercially exploit Krockle content without prior written permission.

15. Third-Party Services and Links

Krockle.us may rely on or link to third-party services, including Stripe, WooCommerce, USPS, Google Analytics, Mailchimp, Instagram, Facebook, and TikTok.

Third-party platforms operate under their own terms, privacy policies, security practices, and availability. Krockle does not control and is not responsible for third-party websites or services.

A link or integration does not necessarily constitute an endorsement of every product, statement, or practice of the third party.

16. Website Availability and Accuracy

Krockle may modify, suspend, update, or discontinue any part of the website when reasonably necessary.

We do not guarantee that the website will always be uninterrupted, error-free, secure, or available. Temporary interruptions may occur because of maintenance, software updates, hosting issues, security incidents, or circumstances outside our control.

Krockle may correct typographical errors, inaccurate descriptions, pricing mistakes, inventory errors, or technical problems at any time.

17. Disclaimer of Warranties

To the fullest extent permitted by law, Krockle.us and its services are provided on an “as is” and “as available” basis.

Except for warranties that cannot legally be excluded, Krockle disclaims implied warranties, including warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted availability.

Nothing in these Terms excludes warranties or consumer rights that cannot be waived under applicable law.

18. Limitation of Liability

To the fullest extent permitted by law, MTM Investments, LLC, Krockle, and their owners, employees, contractors, agents, and service providers will not be liable for indirect, incidental, special, punitive, exemplary, or consequential damages arising from:

• Use of or inability to use the website
• Delivery delays or carrier actions
• Unauthorized access to an account
• Customer misuse or improper storage of a product
• Third-party services or websites
• Loss of data, revenue, profits, or business opportunities

To the fullest extent permitted by law, Krockle’s total liability relating to a particular order will not exceed the amount paid to Krockle for the product or order giving rise to the claim.

These limitations do not apply where liability cannot legally be limited or excluded.

19. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless MTM Investments, LLC, Krockle, and their owners, employees, contractors, and agents from claims, liabilities, damages, losses, and reasonable expenses arising from:

• Your misuse of the website
• Your violation of these Terms
• Your violation of applicable law
• Your infringement of another person’s rights
• Content you submit through the website
• Fraudulent or unauthorized activity connected to your account

20. Governing Law and Disputes

These Terms and any dispute arising from Krockle.us, Krockle products, or a transaction with Krockle will be governed by the laws of the State of Florida, without regard to conflict-of-law principles.

Before filing a legal claim, you agree to contact Krockle at contact@krockle.us and make a good-faith effort to resolve the dispute informally.

Unless applicable law requires otherwise, any legal proceeding will be brought in a state or federal court with appropriate jurisdiction in Orange County, Florida, and the parties consent to that venue and jurisdiction.

Nothing in this section prevents either party from seeking appropriate emergency or injunctive relief or exercising a right that cannot legally be waived.

21. Force Majeure

Krockle will not be responsible for delay or failure caused by events outside its reasonable control, including severe weather, natural disasters, carrier disruptions, labor interruptions, governmental actions, public-health emergencies, power outages, internet failures, supply shortages, civil disturbances, or similar events.

22. Severability and Waiver

If any provision of these Terms is found invalid or unenforceable, the remaining provisions will continue in effect to the fullest extent permitted by law.

Krockle’s failure to enforce a provision does not waive the right to enforce that provision or another provision later.

23. Entire Agreement

These Terms, together with the Privacy Policy, Delivery & Return Policy, product-specific conditions, and promotional terms presented during purchase, constitute the agreement between you and Krockle regarding use of the website and applicable transactions.

24. Changes to These Terms

Krockle may update these Terms to reflect changes in products, services, website functionality, business practices, or legal requirements.

Updated Terms will be published on this page with a revised “Last updated” date. Changes apply prospectively unless otherwise required by law.

Continued use of Krockle.us after updated Terms become effective constitutes acceptance of the revised Terms.
